Agreement to Terms

By accessing, installing, or using our Services, you agree to be bound by these Terms. If you do not

agree to these Terms, please do not use the Services.

Changes to Terms or Services

We may modify these Terms at any time at our sole discretion. If we do so, we may notify you via

email or by posting a notice on our website. Continued use of the Services after such modifications

constitutes your agreement to the updated Terms. If you disagree, you must discontinue use

immediately.

Booking and Payments

We offer adventure trips and corporate retreats, partnering with an established adventure travel

company and subcontractors (outdoor guide companies, outdoor activity operators, etc.) to run our

trip experiences.

Booking through AdventureDesk Ltd.

These forms are ready and used for all bookings, ensuring we collect the necessary participant details

before trips. We provide the initial information to AdventureDesk Ltd. (our travel agency partner),

which then processes the final booking.

The Supplier Agreement applies to fees paid by users for supplier services. Intrepid Peak is

authorized to collect invoiced amounts on behalf of the Supplier.

Payments are accepted only in US Dollars (USD) or Canadian Dollars (CAD). We accept only Visa

and Mastercard debit/credit cards.

Authorization to Share Information

By booking with us and making a non-refundable deposit, you authorize us to share your contact

information (name, email, address, phone number) with the tour operator for reservation purposes in

accordance with our Privacy Policy.

All Intrepid Peak guests must sign a digital liability waiver before trip confirmation. Waivers are sent

upon booking with reminders at 60, 30, and 7 days before departure. Our administrative team tracks

and securely stores waivers for legal compliance.

Cancellations and Refunds

A deposit per traveler is required to secure the reservation. Final payment must be made 60 days

before departure. Before the final payment date, clients may review trip details and cancel without

penalty.

Cancellation Policy

● 59–30 days before departure: 50% of the total trip cost is non-refundable.

● 29–0 days before departure: 100% of the total trip cost is non-refundable.

Flexibility for Unforeseen Events

In cases of emergencies (e.g., flight cancellations, natural disasters), rescheduling may be possible

based on availability.

Emergency Communication

We will promptly inform clients of any trip changes and provide alternative options when necessary.

Additional cancellation fees may be applied by third-party suppliers.

If a trip is canceled due to weather or unsuitable conditions, we will offer:

1. A similar activity in a different location

2. A rescheduled trip at a later date

3. A full cancellation (standard cancellation policy applies if options 1 & 2 are refused).

If a tour operator cancels for non-weather-related reasons, clients will receive a full refund minus the

non-refundable deposit.

Booking Changes

Requests for modifications should be directed to info@intrepidpeak.com. Changes are subject to

availability and may incur additional fees from suppliers. We do not charge an administrative fee for

date changes.

If you used a promotional code or discount, modifications may invalidate the offer.

Vendor Changes

We reserve the right to alter or cancel services, tours, or bookings at any time due to supplier

changes. If significant changes occur, we will notify customers and provide refund options when

applicable.

Passports, Visas, and Insurance

It is the responsibility of all passengers, regardless of nationality and destination, to check with the

consulate of the country they are visiting for current entry requirements. As visa and health

requirements are subject to change without notice, we recommend that you verify health and visa

requirements with the appropriate consulate prior to departure. We strongly recommend that you

purchase a comprehensive Travel Insurance Policy prior to departure. If you cancel your trip or

significantly alter travel dates, many policies will reimburse the cost of cancellation fees and related

expenses.

Pricing

Prices are personalized and provided upon request. Prices are subject to local taxes, fees, and

exchange rate fluctuations.

Unless stated otherwise, prices do not include additional local fees, tips, personal insurance, or

non-listed food and beverages.

Feedback

We welcome feedback, comments, and suggestions for improving the Services. You can submit your

feedback by emailing us at the contact email listed above. After the event, we will reach out to you to

gather your thoughts and experiences. By providing feedback, you grant us a non-exclusive,

worldwide, perpetual, irrevocable, fully paid, royalty-free, sublicensable, and transferable license

under any intellectual property rights you own or control to use, copy, modify, create derivative works

from, and otherwise utilize your feedback for any purpose.

Content

For the purposes of these Terms:

(i) "Content" refers to any text, graphics, images, music, software, audio, video, works of authorship,

and other materials that are posted, created, shared, or otherwise made available through the

Services.

(ii) This also includes any Content that you or other Users provide for availability on the Services.

You are solely responsible for any Content you post, including ensuring its legality, reliability, and

appropriateness. By sharing Content on the Services, you grant us a non-exclusive, transferable,

sublicensable, worldwide, royalty-free license to use, modify, display, perform, reproduce, and

distribute it in connection with the Services. This also allows us to make your Content available to

other Users, who may interact with or use it according to these Terms.

You confirm and warrant that:

● You either own the Content or have the necessary rights to use it and grant us the

permissions outlined in these Terms.

● Uploading or sharing the Content does not infringe on any privacy, publicity, copyright,

contractual, or other rights of any third party.

We do not claim ownership over any Content you share on the Services. These Terms do not limit

your ability to use and exploit your own Content as you see fit. However, by submitting Content, you

provide us with a non-exclusive, non-transferable, non-sublicensable, worldwide license to use it in

relation to the Services, including for promotional and advertising purposes.

User Conduct

Users agree not to engage in inappropriate behavior, including but not limited to harassment,

offensive language, sharing false information, or impersonation.

Intellectual Property

The Services contain material that may be protected under Canadian and international copyright,

trademark, and other proprietary laws, including but not limited to audio, video, graphics, photography,

text, and all Our Content. We, along with our licensors, exclusively own all rights, titles, and interests

in and to the Services and Our Content, including all related intellectual property rights.

You acknowledge that the Services and Our Content are protected by copyright, trademark, and other

applicable laws in Canada and foreign jurisdictions. You agree not to remove, alter, or obscure any

copyright, trademark, service mark, or other proprietary notices incorporated in or accompanying the

Services and Our Content. Furthermore, you may not modify, distribute, publish, transmit, publicly

display, publicly perform, participate in the transfer or sale of, create derivative works from, or

otherwise exploit any of Our Content, in whole or in part, without our express authorization.

Any violation of these restrictions may constitute intellectual property infringement, potentially leading

to civil and/or criminal penalties under applicable Canadian law. You will be solely responsible for any

damages arising from unauthorized use, infringement of copyrights, trademarks, or other proprietary

rights, including any harm resulting from the submission of protected third-party materials without the

explicit permission of the rights holder.

Links and Advertisements of Third Party Websites

The Services may contain links to or advertisements of third-party websites or resources that are not

affiliated with Intrepid Peak Inc. or other Users. We are not responsible for the content, products, or

services available on or from those advertisements, websites, resources, or links. You acknowledge

that you are solely responsible for and assume all risks arising from your use of any third-party

websites or resources.

Indemnity

You agree to defend, indemnify, and hold harmless Intrepid Peak Inc., its officers, directors,

employees, agents, and affiliates, from and against any and all claims, damages, obligations, losses,

liabilities, costs, debts, or expenses (including but not limited to legal fees), to the extent allowed by

applicable law, arising from or caused by:

(i) your use of and access to the Services;

(ii) your violation of these Terms;

(iii) your violation of any third-party rights, including but not limited to copyright, intellectual property,

privacy, or other rights; or

(iv) any claim that your content caused harm or damage to a third party. This section will survive the

termination of these Terms.

Warranty Disclaimers

The Services and Content are provided "AS IS," without any warranty of any kind. Intrepid Peak

Adventures Inc. explicitly disclaims any warranties of merchantability, fitness for a particular purpose,

quiet enjoyment, or non-infringement, as well as any warranties arising from the course of dealings or

trade usage. We make no warranty that the Services will meet your requirements or be available on

an uninterrupted, secure, or error-free basis. We make no warranty regarding the quality, accuracy,

timeliness, truthfulness, completeness, or reliability of any Content.

Limitation of Liability

Neither Intrepid Peak Adventures Inc. nor any other party involved in creating or delivering the

services or content will be liable for incidental, special, exemplary, or consequential damages,

including lost profits, loss of data, service interruptions, mobile damage, system failure, or the cost of

substitute services, arising out of or in connection with these Terms or the use or inability to use the

Services or Content.

Dispute Resolution

We prefer to resolve disputes amicably when possible. If there is a dispute regarding these Terms,

please notify us via email.

● Informal Negotiations: The parties will attempt to resolve the dispute informally.

● Arbitration: If informal negotiations fail, the parties agree to follow the arbitration procedures

set forth by the American Arbitration Association (AAA).

● Binding Arbitration: If arbitration is not successful or available, the parties agree to submit to

binding arbitration in the jurisdiction of British Columbia, Canada. Each party is responsible

for its own arbitration fees.

Entire Agreement

These Terms constitute the complete and exclusive agreement between you and Intrepid Peak

Adventures Inc., superseding any prior agreements. If any provision of these Terms is found invalid or

unenforceable by a court, the remaining provisions will remain in full force. You may not assign or

transfer these Terms without our prior written consent.
